Administrative Review Help

Think the Home Office made a mistake in refusing your application?

Administrative review asks a different caseworker to check an eligible decision for errors. It is available for many work and study refusals where there is no right of appeal.

Administrative Review

When it applies

The refusal notice says whether administrative review is available. It typically covers decisions on work, study and some other routes, both in the UK and overseas.

What counts as a caseworking error

  • Applying the wrong rule or policy
  • Overlooking evidence that was submitted
  • Miscalculating dates, periods or amounts
  • Wrongly deciding that a document was not genuine or not provided
  • Granting permission for the wrong period or with the wrong conditions

What it cannot do

Administrative review is not a second application. New evidence is accepted only in narrow circumstances. If the refusal was correct on the evidence sent, a fresh application is usually the better route.

Deadlines

Time limits start running when the decision is sent or received and they are short. Missing one can close a route completely. Send the decision for review as soon as you have it.

How it works

  • Check the notice for eligibility and the deadline
  • Identify each error with reference to the rules and the evidence
  • Submit the review request and fee
  • Wait for the outcome: the decision is upheld, changed or withdrawn

Frequently asked questions

01Can I stay in the UK during the review?

If you applied in time from inside the UK, your position is normally protected while the review is pending.

02Can I make a new application at the same time?

A new application usually brings a pending review to an end. Decide on one course.

03What if the review fails?

Depending on the case, options may include a fresh application or judicial review.
